A university official emailed FAU English professor Kate Polak on Monday notifying her that she had been placed on paid administrative leave while the school investigates her social media activity.
Polak said she remains confused by the administration’s reasoning for the suspension, adding that she made multiple attempts to get answers from officials but received none. The University Press obtained screenshots from a student who requested anonymity, showing comments from Polak’s Instagram Threads account on other users’ posts about the late conservative activist Charlie Kirk, who was fatally shot Sept. 10 at Utah Valley University.
Polak acknowledged the comments from her account, saying she did not write the actual post but replied in the public comments. She emphasized that she never encouraged violence and argued the comments are protected by the First Amendment, which she believes the university is violating. She said that anyone who does not believe these actions from the university is a violation of freedom of speech is “un-American.”
“I think my biggest frustration with this is that I work in the Culture and Society building, and we have ‘the right to free speech’ in stone on that building. I think it’s a sincere problem that I could be censured for things said in my private time regarding, once again, things that are none of my employer’s business,” said Polak.
The university’s actions came shortly after President Adam Hasner announced on Sept. 13 that an unidentified tenured faculty member was placed on leave pending an investigation involving repeated reposts of social media content about Kirk’s assassination. “Our focus remains on our academic community’s responsibility to promote civil discourse, conduct healthy debate, and treat one another with respect. This applies to all students, faculty, and staff, no matter their political leanings,” wrote Hasner in the statement.
FAU associate professor of art history Karen Leader confirmed she is the faculty member placed on leave in the separate case. In a recent University Press article, Leader called Hasner’s accusations inaccurate, saying she did not post on her X account about Kirk’s fatal shooting but rather about his public statements.
University spokesperson Lisa Metcalf wrote in an email to the University Press that “Florida Atlantic University does not comment on personnel matters,” and declined to comment further about the case regarding Professor Polak. According to copies of the emails that Polak provided to the University Press, Department of English Chair Oliver Buckton notified her about the administrative leave and directed her not to come to campus until further notice.
“The investigation will include a review of your conduct, including, but not limited to, your recent social media posts that the university reasonably believes might disrupt the efficient functioning of the university, and/or jeopardize the safety or welfare of other employees, colleagues, or students,” reads the email from Buckton.
Polak said that nowhere in the notice did it state what specific social media content was the reason for her administrative leave. The University Press obtained a Canvas message from an anonymous student in Polak’s College Writing 2 class: “I have been placed on administrative leave. It is a very obvious violation of my First Amendment rights, and I have already retained legal counsel to defend me against this threat to my career.” Polak also apologized for the disruption to their education in the message.
Polak said her biggest goal in the classroom is to create a safe space for her students, regardless of political ideology. “I want all of my students, regardless of their personal beliefs, to be comfortable. And so I deliver my intellectual content to them, and sometimes that has political dimensions, but I am not pushing any political angle,” said Polak.
Ian MacDonald, an FAU English professor and Polak’s partner, called the situation “frustratingly illegal” and said it’s hard to know what to do, adding that they have contacted an attorney.
“We’re preparing ourselves to both fight for the legal right to free speech, which is not only bound in the First Amendment but also a core to the epistemological rationalization of the university in the first place,” said MacDonald.

Regardless and nonetheless, keep your opinions to yourself and even when you are not working nor on their time, you are a figure to those around you and especially within the college. It is inappropriate and at this time can and quite clearly will not be taken lightly. Your encouragement of ANY SORT for I’ll mannerisms and poor behavior is disgusting. I am thankful they are removing people of whom cannot keep their opinions to their selves, yet also want to state them publicly and then want to cry about it and how “unfair” it is as well as everyone crying out “my first amendment ” blah blah. The first amendment to the constitution guarantees the right to say what you want about the United States government. It protects the freedoms of speech, the press, religion, assembly, and the right to petition the government from government interference. It does not protect an individual in speaking their mind in a work environment. Surprising that a professor at a University doesn’t have a better grasp of the constitution and it’s amendments. I think more people are finding out about the limits of the first amendment.

It is happening in the media. Censorship at two major broadcast studio’s. From the top tiers on down censorship is on the rise and there is no one preson in our federal government or judicial system willing to stand against this form of censorship or obvious revenge. Our leaders are cowed by the toxic revenge statements that is vomited daily by the leaders that are ruling Washington. That is how tyrants rule through fear, distractions, false narratives and revenge.

Yes, the First Amendment has limits. It does not protect categories of speech considered “unprotected,” such as obscenity, defamation, true threats, and incitement to imminent lawless action. Additionally, while not censoring content, the government can place time, place, and manner restrictions on how and where speech occurs to prevent disruption or harm. Actions have consequences. She taught English. The proper writing of the English language. If she does not know the US Constitution, maybe she should read it and learn what our founders and the Supreme Court has decided on numerous 1st Amendment cases where it was abused. There are more cases worse than yelling, “fire” in a crowded theater.

It does not however protect you from your employer or your peers. Like it or not, public universities, although funded by government, are not considered government offices. The left’s position on the death penalty for murderers, serial rapists, etc is that it should be abolished, but apparently it should be allowed for saying things they disagree with, even if those quotes aren’t remotely what Charlie believed.

Freedom of Speech is a protected constitutional right against government censorship and is very limited in a NON government settings. What most people fail to realize, most companies, public companies, schools have a code of conduct re: speech, dress and representation. That’s not how it works, Jake. Any employer, including government employers, can terminate people who violate codes of conduct, ethics, or the core mission of the institution, which includes speech. The First Amendment isn’t a shield in which a person can deflect any personal responsibility for their actions. It also doesn’t protect you from getting fired by the government. Unless she is arrested and jailed for her posts, her rights haven’t been violated. She isn’t being silenced, she’s being held accountable. She can still say whatever she wants, she just can’t say it while working at FAU anymore.

I am a retired public school teacher. We as teachers in the public school were warned to be careful what we posted on social media. If it was a message that was not becoming for our educational community, students then we were aware we could lose our job. What you post in your private life or comment on can still be seen by your students. It doesn’t matter if you didn’t do it in the workplace.

She works in a Public University and as such should represent behavior that is consistent with the University standards and the community that pays her. I am Retired from the state and we had to follow an ethics code and refrain from personal statements and comments which reflected badly. SMH

If you make a comment during work hours or have your employer on your profile you chose to represent them outside of business hours. Remove any employees, logos or representation of any kind off of your profile, that is the connection. The US Constitution guarantees the freedom to express your opinion without government interference or retaliation. However, just because you CAN say something does not mean you SHOULD say something. In the case of Charli Kirk…there were a lot of things he said and stood for that I disagreed with. And just like Charlie Kirk, we all have the right to our opinions and to express them. What happened to Charlie Kirk was horrendous…and no one should celebrate or glorify his death. But, just because someone has posted something opposing Charlie Kirk’s views or beliefs should not result in retaliatory action by their employer. Charlie Kirk said a lot of things that were derogatory about other people and/or their beliefs, lifestyle, or viewpoints. People have a right to respond to those comments…even after he was killed.

Second, EVERYONE is guaranteed the right to freedom of speech and press in the Constitution of the United States of America. That doesn’t mean that ANYONE is held to ANY standard. That means that we all have the SAME rights and freedoms no matter our job titles or positions of power.
Sometimes, we may not like what other’s ideas, beliefs, and opinions are, but it doesn’t change the fact that in THIS country we ALL have the right to speak out. The thing is-ideas, beliefs, opinions-all of these things CAN be dangerous. This professor is fighting for all of us. Court precedents can bring us back from recent stepts toward authoritarianism. My momma taught me that it’s rude to say bad things about the dead, however never did I imagine that people would lose their jobs, their visas, or be kicked out of the military for it. As an American who appreciates the sacrifices of brave people that were necessary to gain and maintain our civil liberties, I am flummoxed by the people who gleefully watch them be eroded away, and those who help with the erosion.

The 1st amendment states that Congress shall make no law abridging free speech. This mean you can’t be criminally prosecuted for your speech (outside of inciting violence or endangering the public) but it doesn’t protect you from reprocussions from your speech.

How are you drawing the conclusion that what she said was, in any way, “celebrating the death of a young husband and father?” She CLEARLY said nothing of the sort. In fact, she specifically said, “I am not in support of what happened to Charlie Kirk, but Charlie Kirk was in support of what happened to Charlie Kirk.”
Since when is making a statement that one does not support something, “celebrating the death of a young husband and father?” Or are you just upset that she said a thing you didn’t like?
The truth of the matter is that, Charlie Kirk, did indeed, advocate for the things that happened, not only to him, but to children in many schools, and to others in places all across the United States. He said, on more than one occasion (in fact it was one of his consistent talking points), that the number of gun related deaths in this country are, “acceptable in order for us to have the second amendment.” Those were his words. He also advocated for public executions to be a requirement and that children should be forced to watch as well. Again, those were his words.
Exactly where did anything she say, “Celebrate the death of a young husband and Father?”
It seems to me that there are a LOT of people, nowadays, who get really upset when THEIR free speech is infringed upon, but the second someone says ANYTHING they do not like, there’s, “hell to pay.” How has this, “holier than thou,” attitude become part of the United States of America? Since when has freedom of speech not extended to EVERYONE who is a citizen on United States soil?
It’s beginning to look a lot like all of the rights and freedoms every citizen is guaranteed and entitled to by, not ONLY our Constitution, but (according to the Constitution and the founding fathers) the rights and liberties we’re ALL born with and given by God or whatever higher power each of us believes in-are, somehow, only for people who think a certain way or believe a certain way. Yet, we ALL know that was NEVER the intention for the United States of America.
While I WILL agree that, “freedom of speech,” does not mean, “freedom from consequences,” I think as human beings we have to learn to understand that not everyone thinks, feels, and believes the same way. It isn’t difficult to disagree with each other’s ideas and beliefs while not stifling the expression of those ideas and beliefs. Isn’t that the ENTIRE point of all of us being able to speak what we believe?

No but schools also have polices you can’t violate and supreme court has ruled code of conduct violations in policy are legal grounds for termination, if your code of conduct prevent you from discussing or participating in certain types of discussion freedom so speech isn’t protected as you signed an agreement to follow these policies. As powerful as the the conistution is, it wasn’t made absolute, it was left open-ended so mistakes could be amended knowing not every law/rule could cover every situation. Being that kirks death is a political issue on top of everything else, free speech may not extend to discussions if the code of conduct says you will not engage in political discussions. HONESTLY, if your employed by a company and they can see your behavior and people can directly see An attachment to that company you are representing that company regardless what your doing personally and it has been legal ground for termination, so if your comments are viewed as not in line with the establish charter, BYE. you shouldn’t be discussing stuff when your in a position of “power” and a teach is in one of the most important positons. She’ll need a really good lawyer if the school decides her action violated her agreement. The Constitution of the United States’ of America, states that Freedom of speech and of the press belongs to EVERYONE in this country. That includes people with opinions, ideas, and beliefs that we may not like. In fact, the entire point of freedom of speech and press is so that we do not live in an echo chamber.
Ideas, beliefs, and opinions CAN (and sometimes are), dangerous. If we are ALL unable to express those ideas, beliefs, and opinions with each other and, to have “good faith debate,” with each other about those ideas, beliefs, and opinions-then we will all be stuck in an echo chamber and there will be no one to challenge what we think or believe. That alone is very dangerous. The founding fathers, while imperfect, knew this.
Freedom of speech and press exists because of, and in spite of, others’ feelings. Everyone needs to remember that not everyone in this country is a, “radical extremist,” but everyone has ideas, beliefs, and opinions. ALL of us, including radicals and yes, EVEN extremists are entitled to free speech as citizens of this country. If you do not like or believe in that, then you’re not aligned with the Constitution of your country and THAT’S unamerican.

Screenshots show Professor Kate Polak posting memes of Charlie Kirk being shot, laughing that he “got what he deserved,” and celebrating his death as “winning the gun control debate.” She has since deleted her Threads account and many of these posts, but screenshots have been circulating. I sent them to copy editor Ava Hilton as she only included one screenshot and it had Polak’s comment under the meme cut off. The article has not been updated yet to reflect that. Polak is now trying to cover herself by deleting evidence and feigning confusion about being placed on leave. This is her second time facing reprimand from FAU for violating the professional code of conduct.

Obviously everything will come out eventually and if she did say what you claim she did, her challenging will make it much more public knowledge. Have you ever read or listened to what kirk believed and said? Kirk was just a podcaster. He was a bigot. He believed people dying by gun violence was an acceptable price to pay to keep guns. Tell that to the grieving mothers of dead babies. He believed Women had no right to vote or hold public office. He said black women did not have the competency or brains to hold high positions of power,that state executions should be public and children watch. These are just a few. He traveled to colleges to debate 18 year olds.Frequently he was bested and his views had holes punched in them. Of course those episodes were not featured on his podcasts. He was not a hero.
