The State has decided not to prosecute Omar Everton Graham Jr., the suspect in last April’s shooting at the University Village Student Apartments, according to the Palm Beach County court docket.
Graham appeared in court on June 20, 2008, facing charges of attempted murder, aggravated battery, and possession of and discharging of a firearm on school property. The case was closed June 24, after the “State failed to file charges because of insufficient evidence.” According to Palm Beach County court employees, this does not exclude the possibility that charges may be filed at a later date.
At the time of the shooting, Graham was a junior in the culinary arts college at Johnson & Wales University. He had a prior arrest for marijuana possession, but that case was dismissed.
On April 30, at around 1 a.m., Graham, 23, shot a gun after a fight at the student apartments. Graham told police that two people at the party were staring at him in a “menacing” manner. He pulled the gun when they approached him in order to discourage what he felt was an imminent confrontation. It was at this point that the gun went off, followed by a fistfight. Later police found what appeared to be a bullet hole in the wall of the apartment. No one was injured in the shooting.
After the shooting, FAU was put on lockdown and students were told to stay in their rooms. The lockdown ended on April 30 at around noon, and classes resumed the following day. Soon after, Graham was arrested at Johnson &Wales University in North Miami and taken to Palm Beach County jail. Bail was placed at $35,000.
